1. Scope and acceptance
These terms govern the use of emire-eyewear.com and distance sales concluded with EMIRE Eyewear. The version applicable to an order is the one available when it is confirmed. Mandatory consumer rights remain fully applicable.
2. Seller and contact
The shop is operated under the EMIRE Eyewear brand. Customer service can be reached at contact@emire-eyewear.com. References shown on the order confirmation and sales documents identify the relevant transaction.
3. Products and availability
Essential characteristics, dimensions, materials, colours, lenses, and prices are shown on the product page. Photographs are prepared with care, but colour rendering may vary by screen. Minor finishing differences consistent with the stated quality do not necessarily constitute a defect.
Offers remain valid while stocks last. If unavailability is discovered after ordering, an alternative may be offered or the order may be cancelled and any amount already collected refunded.
4. Prices, taxes, and charges
Applicable prices and currency are displayed before confirmation. The order summary shows delivery charges and the total due. For certain international destinations, customs duties, import taxes, or local fees may be charged to the recipient unless stated otherwise at checkout.
5. Formation of the order
You must check the cart, address, and selected options before confirming. Automatic receipt of a request does not guarantee final acceptance. The sale is confirmed when the order is accepted or enters preparation, subject to the offered payment method.
We may refuse or cancel an order in case of unavailability, obvious error, suspected fraud, incomplete information, or inability to deliver. The customer will be informed and any amount improperly retained will be refunded.
6. Payment
The methods actually available are displayed at checkout. Cash on delivery may be offered for certain destinations or orders. Any condition, limit, or verification associated with the selected method is shown before confirmation. The customer warrants being authorised to use the chosen payment method.
7. Delivery
Available delivery areas, methods, costs, and estimates are shown at checkout. Timeframes are estimates unless expressly guaranteed. Customs procedures, public holidays, transport events, or force majeure may extend them.
The customer must provide a complete and accessible address. Risk of loss or damage passes to a consumer when they physically receive the product, subject to mandatory applicable rules.
8. Withdrawal and returns
Where European Union law applies, a consumer generally has fourteen days from receipt to notify withdrawal without giving a reason. Contact contact@emire-eyewear.com with the order reference before returning the product.
The product should be handled only as necessary to establish its nature, characteristics, and proper functioning, and returned with its accessories and protection. Diminished value resulting from excessive handling may be deducted within legal limits.
Direct return costs are borne by the customer where legally permitted and unless a different commercial offer is stated. This does not apply to costs caused by seller error or non-conforming goods. Products made to customer specifications or clearly personalised may be excluded from withdrawal where provided by law.
9. Refunds
For a valid withdrawal, amounts due are refunded by an appropriate method within the legal period. Reimbursement may be withheld until the goods are recovered or evidence of dispatch is received, whichever occurs first. Additional costs arising from a delivery method more expensive than the standard option may remain excluded.
10. Conformity and legal guarantees
Mandatory legal guarantees apply independently of any commercial warranty. For sales governed by European Union law, new goods generally carry a minimum two-year legal conformity guarantee from delivery, subject to more favourable national rules.
For a suspected defect, contact the original seller with proof of purchase, a description, and photographs. Normal wear, use-related scratches, accidents, mishandling, or unauthorised modification do not necessarily constitute a lack of conformity.
11. Damaged parcel or error
Check the order upon receipt. In case of damage, missing items, or an incorrect reference, contact us promptly, retain the packaging, and provide photographs allowing the request to be assessed. This does not reduce your legal rights.
12. Customer account
You are responsible for the accuracy of information provided and the confidentiality of your credentials. Report any unauthorised use without delay. We may suspend an account in case of fraud, abuse, or breach of these terms.
13. Intellectual property
The trademarks, names, text, photographs, videos, frame designs, graphics, and software on the website are protected. No reproduction, adaptation, extraction, or commercial exploitation is permitted without written agreement, except where provided by law.
14. Liability and force majeure
Nothing limits liability or a right that cannot legally be excluded. Subject to this, EMIRE is not liable for unforeseeable indirect losses or delay caused by an event reasonably beyond its control. The website may be temporarily interrupted for maintenance, security, or a technical incident.
15. Applicable law and disputes
Applicable law is determined in accordance with mandatory rules and conflict-of-law rules. Consumers retain protections they cannot waive in their country of residence. Before proceedings, contact us to seek an amicable solution. Recourse to competent authorities or dispute-resolution mechanisms remains available.
16. Changes, severability, and contact
